Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Catchsera platform, including our AI voice agent, admin portal, and all related services, provided by Catchsera, DBA SmartZone. By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have authority to enter into contracts on behalf of your business.

2. The Service

Catchsera provides an AI-powered phone answering and order-taking system for restaurants, including an AI voice agent, admin portal, kitchen display interface, and reporting features.

3. Free Trial

New customers may access the Service on a 7-day free trial with no credit card required. After the trial, continued use requires a paid subscription.

4. Subscription Plans and Billing

Monthly plans may be cancelled before the next billing cycle
Pro plan requires a minimum 3-month commitment
Enterprise plans are governed by a separate written agreement
Overage minutes billed at the rate specified for your plan
We do not charge setup fees

Fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to violate laws, transmit illegal content, reverse-engineer our AI, resell the Service without written consent, or use it for any purpose outside restaurant order-taking.

6. Your Data

You own your business data. You grant Catchsera a limited license to process it to provide the Service. See our Privacy Policy for details.

7. Uptime

We target 99.9% uptime. We are not liable for interruptions from third-party carriers, internet outages, or force majeure events.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. YOUR USE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Termination

Either party may terminate at any time. We may suspend access for violations or non-payment.

11. Governing Law

These Terms are governed by the laws of the State of Texas. Disputes shall be resolved in Texas courts.

12. Changes

We may update these Terms. Material changes will be communicated via email. Continued use constitutes acceptance.
